I don't see why not; the rules state that you keep ownership of your submission, so the openness and availability of your app should be up to you.
That being said, I'll admit that I didn't read 100% of the Rules (just the sections that seemed pertinent), so might have missed m/open.?source/i mentioned anywhere in there.
